Appealing the IND's decision

The Immigration and Naturalisation Service (IND) has rejected your asylum application. What can you do if you disagree with this rejection? Read here about appealing to the Dutch court.

This is how to appeal

If you disagree with the decision of the

IND
, your lawyer can appeal to the court. Discuss with your lawyer whether you want this.

If you have decided you want to appeal, and if your lawyer appeals, the court will decide whether the INDundefineds decision is justified or not. The court does not decide whether you will get a residence permit (as yet), but assesses whether the IND carried out the procedure properly.

The court concludes that the IND did not conduct the procedure properly

If this is the case, the IND must make a new decision. The IND must then re-examine your refugee story and your documents. You will often have another interview with the IND.

The court decides that the IND conducted the procedure properly

In this case, you must leave the Netherlands or you can reapply for asylum.

On appeal

If you disagree with the courtundefineds ruling, your lawyer can appeal to the

Council of State
. This must be done within one week of the courtundefineds ruling. Discuss with your lawyer whether you want to do this. The IND can also appeal the courtundefineds ruling.
