The General Asylum Procedure (AA)

The detailed interview is the second interview with the IND. In this interview you can explain in detail why you fled and why you need protection in the Netherlands. The IND employee also asks questions during the interview and elaborates on your answers. The detailed interview is an important interview. Talk honestly, extensively and clearly about why you fled.

An interpreter is present at the interview. The interpreter does not work for the IND and is independent. The interpreter has no influence on the decision about your asylum application. The IND employee will ask you questions in Dutch. The interpreter will translate these questions into your language. 

Please note: Say immediately if the interpreter and you cannot understand each other well or if you notice that the interpreter translates something different from what you say. The IND will then arrange for another interpreter. It is very important that there are no misunderstandings because you do not understand the questions properly. 

Please note: You can be heard by an interpreter and IND employee of your own gender if you wish.

• After the detailed interview, you and your lawyer will discuss the report the Immigration and Naturalisation Service (IND) made about the interview.

• Tell your lawyer if information is missing or incorrect in the IND report. Your lawyer will then send a letter to the IND.

There are three possibilities:

1. The IND approves your asylum application: You will receive a letter from the IND stating that your application has been approved. You can then

   

   apply for a permanent residence permit
   . The residence permit can be revoked within five years, for example if your country of origin is safe again. Your residence permit can also be revoked if it turns out that you did not tell the truth during your asylum application.

2. The IND intends to reject your asylum application: You will receive a letter from the IND stating that the IND intends to reject your application for asylum. This letter contains the reasons for rejection and the consequences for you.

3. The IND needs more time for investigation and cannot decide on your asylum application within 6 or 9 days. The IND will continue processing your application in the General Asylum Procedure (AA).

• You discuss the letter containing the undefinedvoornemen tot afwijzingundefined (intention to reject) from the Immigration and Naturalisation Service (IND) with your lawyer.

• Your lawyer has 1 day to respond to the INDundefineds intention with a letter. This letter is called the undefinedzienswijzeundefined (standpoint). The IND must take the standpoint into account.

• After reading the standpoint, the IND decides whether to modify the intention.

• You will receive a letter with the decision from the Immigration and Naturalisation Service (IND). There are 3 possibilities:

1. After reading the standpoint, the IND approves your asylum application after all. You will receive a letter from the IND stating that your asylum application has been approved. This letter also indicates whether you have status-a or status-b.

2. The IND needs more time for investigation and cannot decide on your asylum application within 6 or 9 days. The IND will continue processing your application in the Extended Asylum Procedure (VA).

3. The IND rejects your application: You will receive a letter from the IND stating that your application for asylum has been rejected. This letter is called the undefinedbeschikkingundefined (decision). The decision contains the reasons for rejection. The IND may have changed the reasons based on the lawyerundefineds standpoint. The lawyer will discuss the decision with you. 

What consequences does this have?

You can no longer stay in the Netherlands and must return to your country of origin. The Dutch Repatriation undefined Departure Service (DTundefinedV) will talk to you about your return.
