Conditions for temporary protection in the Netherlands
If you fled Ukraine but do not have Ukrainian citizenship, you may not be covered by the Dutch Temporary Protection Directive. If you are not covered, you can apply for asylum, apply for a regular permit or return to your country of origin.
Right to Temporary Protection
You are entitled to Temporary Protection if:
You had international protection in Ukraine on 23 February 2022.
You had a valid permanent Ukrainian residence permit on 23 February 2022, you travelled out of Ukraine after 26 November 2021, and you were not in your country of origin after 23 February 2022.
You had a valid temporary Ukrainian residence permit on 23 February 2022 and you were registered with a Dutch municipality before 19 July 2022. In this case, you are entitled to temporary protection until 4 March 2023. After this date your right to temporary protection expires.
You are a partner, an unmarried child under 18, or cohabiting relative of someone who has Temporary Protection.
No right to Temporary Protection
You are not entitled to temporary protection if:
You have a temporary Ukrainian residence permit (e.g. for work or study) and are not registered with a Dutch municipality before 19 July 2022.
You have insufficient documents to prove that you are covered by Temporary Protection.
You filed an application for (inter)national protection in Ukraine, which has not yet been decided on, you do not fall under Temporary Protection.
Depending on your situation, there are several options you can explore, such as:
1. Apply for asylum
2. Apply for a regular residence permit
3. Return to your country of origin
It is not clear whether I am entitled to Temporary Protection
The municipality will then arrange for you to get an appointment with the Dutch Immigration and Naturalisation Service (IND). The IND will then start a conversation with you. On the basis of your documents, the IND will determine whether or not you will receive protection in the Netherlands. It is therefore important to bring all your documents with you to your appointment with the IND.
