The IND makes a decision in the accelerated asylum procedure

The IND will make a decision on your asylum application based on the interview with you and the documents you show, and on its own research and information.

If the IND does not approve your application, you must leave the Netherlands.

There are three possible decisions the

Immigration and Naturalisation Service (IND)
can make:

  • The IND believes that more investigation is needed before it can make a decision. The IND will then process your application further in the general asylum procedure or the

    extended asylum procedure
    . You move to another asylum seekers' centre.

  • The IND rejects your asylum application. So you get a negative decision and you have to leave the Netherlands. Your lawyer can lodge an appeal for you with a Dutch court. The court will then assess whether the IND has handled your asylum application properly: in accordance with Dutch law. Usually you can wait for the decision of the court in the Netherlands and stay where you are living.

    • Does the court agree with the IND's decision?

      Then you must leave the Netherlands immediately. You are no longer entitled to a place in a reception centre and you usually receive an entry ban. This means that you are no longer allowed to enter the European Union, after you leave the EU. You move to a reception centre to return to your country of origin.

    • Does the court disagree with the IND's decision?

      Then the IND will also process your application in a different procedure. You move to a different asylum seekers' centre and the IND makes another decision.

  • The IND approves your asylum application. You are allowed to stay in the Netherlands.

    You get a letter saying that your asylum application has been approved. You will receive an asylum residence permit. This is valid for 5 years from the date you applied for asylum. After 5 years you can apply for a permanent asylum residence permit.
