Once your application has been received and processed, the IND will determine which asylum procedure applies to you. In this article, you can find out what the IND takes into account. The IND will assess your situation

The

uses the information you provided during the
phase. For example, the IND looks at:

  • Who you are.

  • Where you are from.

  • What documents you have.

  • How you travelled to the Netherlands.

  • Whether you have previously visited another European country.

  • Whether you have family members in the Netherlands or in another European country.

  • Why you are applying for asylum.

  • Your health or vulnerability.

  • Safety.

The IND uses this information to determine how your asylum application will be processed.

Your application may be processed under the standard asylum procedure

Your application may be processed under the standard asylum procedure. This is the procedure under which the IND assesses the merits of your asylum application.

During this procedure, the IND will assess whether you need protection in the Netherlands. You will be given an explanation of the procedure. You will then prepare for your interview with the IND together with your lawyer. During the interview, you will explain why you are applying for asylum. The IND will then make a decision.

Your asylum application may be processed under the accelerated asylum procedure

Sometimes the IND processes your application more quickly. In that case, you will be placed in the

.

In the accelerated asylum procedure, too, you will usually have an interview with the IND. The IND also refers to this as a hearing. During this interview, you explain why you are applying for asylum.

Your application may, for example, be processed under the accelerated procedure if:

  • You come from a safe country.

  • You come from a country where few people are granted asylum.

  • You have previously applied for asylum.

  • The IND believes that your application is likely to be rejected soon.

  • The IND believes that you have provided incorrect information or withheld important information.

  • The IND believes that you have applied for asylum in order to prevent or delay your return.

Even if this is your first asylum application in the Netherlands, your application may sometimes be treated as a subsequent application. This may happen if you have previously applied for asylum in another European country. The IND may then process your application under the accelerated procedure.

The accelerated asylum procedure has much shorter time limits than the standard asylum procedure. This means you have less time to prepare, gather documents or seek help.

The IND may investigate whether another European country is responsible

The IND may also investigate whether another

country or Switzerland is responsible for your asylum application. This can happen, for example, if:

  • You have previously applied for asylum in another European country.

  • You are registered in another European country.

  • You entered Europe via another European country.

  • You have, or have had, a visa or residence permit from another European country.

  • Your family members live in another European country.

The IND may first need to check whether the Netherlands is processing your application

Sometimes, the IND first assesses whether the Netherlands will consider the merits of your asylum application. This is known as the

.

This may happen, for example, if you are already receiving protection in another country. In that case, the IND will first assess whether your asylum application will be considered further in the Netherlands.

The border procedure is a separate procedure

Are you applying for asylum at an airport or in a port, for example at Schiphol? If so, you may be subject to the border procedure.
