Conditions for a regular residence permit in addition to right of residence through the Temporary Protection Directive

If you have fled from Ukraine and are staying in the Netherlands under the Temporary Protection Directive (TPD), you can apply for a regular residence permit. If you meet the conditions, you can get a regular residence permit in addition to the Temporary Protection. Read how that works here.

There are several regular residence permits

These are the most common regular residence permits:

  • Study permit: You can get this if you are studying in the Netherlands.

  • Work permit: You can get this if you have a job in the Netherlands.

  • Partner permit: You can get this if you have a partner or spouse who has a residence permit and lives in the Netherlands or is a Dutch citizen.

  • Residence permit as a skilled migrant.

In addition, there are other types of regular residence permits. Find out more about this on the IND website.

One of the conditions for getting a regular residence permit is that you have an

authorisation of provisional residence ('Machtiging tot Voorlopig Verblijf', mvv)
. An mvv is a type of visa you need to come to the Netherlands, and then get a regular residence permit. As long as a temporary Ukrainian residence permit allows you to use the rights of the TPD
in the Netherlands, you do not need to apply for an mvv for the time being.

A regular residence permit is different from the temporary protection or asylum permit

You must meet several conditions to get a regular residence permit. It also costs money to apply for a regular residence permit. The

Immigration and Naturalisation Service (IND)
can revoke your regular permit if you no longer meet the conditions, for example, because you have stopped studying, no longer have a job or you are no longer in a relationship with your partner.

Your rights do not change if you first had temporary protection and now also have a regular residence permit

Sometimes you get temporary protection in the Netherlands first and later a regular residence permit for work or study. Your rights do not change then. This means that you are still entitled to a place in a reception centre and healthcare through the Regulation on Medical Care of Displaced Persons - RMO. You will still be entitled to living allowance unless you have income because you are working. Not all municipalities know this, but you are entitled to it.

These are the conditions for a study permit

Do you want to study in the Netherlands and get a residence permit based on that? Then you need a study permit. There are several conditions to get a study permit. For example, you must show that you are enrolled at a Dutch college or university. You must also have sufficient income. The school will do the application with the IND for you. This costs € 228. For information about these conditions, you can contact the college or university where you want to study. They will help you apply for a study permit.

Are you not in the Netherlands yet? In order to travel to the Netherlands because of your permit, you must apply for and pick up a

'Machtiging tot Voorlopig Verblijf' (authorisation of provisional residence)
at the Dutch embassy in Ukraine.

These are the conditions for a work permit

There are strict conditions if you want to apply for a work permit. For example, it must be clear that there is no one in the European Union who can also do your work. The employer makes the application for your work permit to the IND. An employer only does this if you are a specialist in your work. Without education and diplomas, you usually have no chance of getting a work permit either.

Do you fall under temporary protection and have a job in the Netherlands? Then you usually cannot get a work permit.

Are you not in the Netherlands yet? In order to travel to the Netherlands because of your permit, you must apply for and pick up an MVV at the Dutch embassy in Ukraine.

These are the conditions for a partner permit based on your partner in the Netherlands

Do you have a partner or spouse in the Netherlands with a residence permit? Then you can sometimes get a regular residence permit. Your spouse or partner must live in the Netherlands, have Dutch citizenship or have a residence permit in the Netherlands. The application costs €228. Your relationship must meet these conditions:

  • You are in a serious relationship or you are married.

  • Both of you are 21 years of age or older.

  • You will live with your spouse/partner.

  • Your spouse/partner has enough income. You can find the exact amount of income on the IND website.

A partner permit is also possible if your partner has a temporary residence permit. Then enough income is not always required.
