The IND will assess whether your asylum application will be processed under the border procedure

The Immigration and Naturalisation Service (IND) will assess whether your asylum application is to be processed under the border procedure. The IND will, for example, consider:

• Who you are.

• Your age.

• Whether you have come on your own or with your family.

• Whether you have children travelling with you.

• Your health.

• Whether you need extra support.

• Whether the IND can process your application under the border procedure.

Sometimes your application remains in the border procedure. Sometimes the IND decides that a different asylum procedure is more appropriate.

Are you under 18 and have you come to the Netherlands on your own? If so, you will not usually be subject to the border procedure.

Are you coming with your family and do you have children under the age of 18? If so, the IND will not usually process your application under the border procedure. You will then usually be taken to a different reception location. The IND will then process your application under a different asylum procedure, such as the standard asylum procedure or the

Sometimes the IND does process your application under the border procedure after all. For example, if the IND has doubts as to whether you really belong together as a family.

The IND may decide that you will not remain in the border procedure if you are too vulnerable. For example, due to mental health issues, medical problems or because you have been a victim of violence.

If you need extra help, tell your lawyer or the VluchtelingenWerk Nederland (VWN) as soon as possible.

If the IND decides not to proceed with your application under the border procedure, you will usually be moved to another reception location.

Your asylum application will then be processed under a different asylum procedure. The IND will inform you which procedure applies to you.

You will be assigned a lawyer right from the start of the border procedure. Are you unsure why you are in the border procedure? Or are you unsure why you are being transferred to a different procedure? If so, please discuss this with your lawyer as soon as possible.

The IND employee will ask the questions in Dutch. The interpreter will translate these questions for you. The interpreter will also translate your answers into Dutch. The interpreter is independent. The interpreter does not work for the IND and has no influence on the decision regarding your asylum application.

Sometimes you may be assigned an interpreter who speaks a different dialect. Let them know straight away if you and the interpreter are having trouble understanding each other. It is important to avoid any misunderstandings arising from you and the interpreter not understanding each other properly.

Your 1st interview with the IND is alone, without a lawyer. You will only get a lawyer just before the 2nd interview.

It is very important that you say the same thing in the 2nd interview with the IND as you did in the 1st interview. For example, about your family members. Be honest about your family members during the interview. If you later want to apply for family reunification, the IND will check if you talked about your family members during the interview.

During all spoken interviews with the IND, you are allowed to take notes. You can make a timeline to remember important dates. If you cannot remember a date, be honest with the IND. During the interview with the IND, you can hand in documents that support your story.
