You may stay in a reception centre without Ukrainian citizenship
Published at: 8/31/2023, 12:32 PM

If your temporary protection would end on 4 September because you do not have Ukrainian citizenship, your protection will not end. You may remain in the reception centre. Read about all the consequences here.

The IND sent you an official letter stating that your protection is ending

The IND has sent you a letter that you can stay in the Netherlands longer after all. Earlier, you received another letter from the IND. This letter is called a decision. This was a letter stating that the IND has decided to terminate your temporary protection. You now receive a letter that you are allowed to stay for the time being. Here is an example of the letter in Dutch and in English.

Here are the consequences if your protection ends on 4 September:

  • You are still allowed to stay in the reception centre for refugees from Ukraine in the Netherlands until the

    Council of State
    issues a ruling.

  • You may continue to work until the Council of State issues its ruling. If you already have an asylum application pending then different rules apply.

Continuing to work during the asylum process

  • Once the Council of State makes a decision, you still have 28 days to leave the Netherlands.

These are your options if your protection has ended

  • You can appeal the IND's decision

If you disagree with the termination of your protection, you can appeal. You may only be allowed to stay in the Netherlands after a court ruling if you appeal. If you do not appeal, the court's ruling will not apply to you and your protection will stop after the ruling of the highest court, the Council of State.

Appealing against termination of Right to Temporary Protection
On this page you can read that you can appeal against the termination of temporary protection. This applies to people who had a temporary residence permit in Ukraine.

Please note: You can both initiate asylum proceedings and object the termination of your Temporary Protection.

  • You can apply for asylum

In the Netherlands, you always have the right to apply for asylum. If you have previously decided not to apply for asylum but now want to continue with the asylum application, you can call the IND at telephone number 088 043 04 30. Employees of VluchtelingenWerk Nederland and your lawyer can help you with this.

  • You can return to your country of origin or a country where you have a permanent residence permit

You can return to your country of origin or a country where you have a permanent residence permit. You can get a financial contribution from the Dutch government for this, this is called the 'remigratieregeling' (remigration scheme).

  • Staying in the Netherlands without a residence permit

If you do not appeal and stay in the Netherlands after the RvS ruling, you are in the Netherlands without a residence permit. From that moment on, you are in the Netherlands without permission. The Aliens Police then has the right to deport you from the country.

Without a residence permit, you have no right to a place in a reception centre, work or financial support. You lose your BSN, health insurance and your bank account. You do have the right to medical care, but you have to pay for this yourself.
